Terms of Service

By creating an account or using TOM AI™, you agree to these Terms. You must be at least 18 years old to use TOM AI.

TOM AI helps businesses with Instagram audits, growth strategy and content creation using artificial intelligence. TOM AI is not affiliated with, endorsed by or sponsored by Instagram or Meta.

New eligible customers start with a 7-day free trial. A payment card is required at signup, but you are not charged during the trial. Unless you cancel before the trial ends, your card is automatically charged $29 USD per month, plus applicable taxes calculated at checkout, starting when the trial ends. The plan renews automatically each month until you cancel. One free trial per customer; repeat trials are not permitted.

During the free trial: up to 5 combined uses of Ask TOM AI and Create My Content, plus 1 Instagram audit, for the whole trial. Paid plan: up to 30 combined uses of Ask TOM AI and Create My Content, plus up to 2 Instagram audits, in each paid monthly billing period; unused allowances do not roll over. No more than 5 AI requests are permitted in any rolling 24-hour period. AI features, including screenshot uploads, are available only while a trial or paid subscription is valid; failed, unpaid or expired subscriptions pause them until payment is resolved.

If a payment fails, new AI usage is suspended immediately while Stripe retries the payment automatically for a limited period (about one week). Access is restored automatically as soon as a retry succeeds. If all retries fail, your subscription ends and paid access stops. Your saved work remains in your Library throughout.

All TOM AI subscription payments are final and non-refundable, including initial purchases, renewals, unused allowances, and partially used billing periods, except where a refund is required by applicable law. TOM AI provides immediate access to digital services and AI-generated materials upon successful payment.

You may cancel at any time to prevent future renewal charges. Cancellation does not refund payments already made, and you retain access through the end of your current paid billing period. See our Refund & Cancellation Policy.

You own the information you provide and the content TOM AI creates for you. You are responsible for the content you upload and publish, and for having the right to upload any screenshots or business information you share. Do not use TOM AI for unlawful, harmful or deceptive purposes.

AI-generated recommendations and content may be inaccurate, incomplete or unsuitable for your situation. Review everything before you use it. TOM AI does not guarantee any follower growth, engagement, sales, income or other results, and does not provide legal, financial or tax advice.

We may update or suspend features, or suspend accounts that break these Terms. We will give at least 30 days' advance notice of material changes to these Terms, except where a shorter period is required by law or an urgent security or legal issue requires immediate action.

To the extent permitted by law, TOM AI is provided "as is", and our total liability for any claim is limited to the amount you paid in the 12 months before the claim.

These Terms are governed by the laws of the State of Texas, United States, except where the law of your place of residence requires otherwise.
